2. Copyright & Image Ownership

All photographs created by Lasting Memories Fine Art Photography are the exclusive intellectual property of Karla Mejia, protected under United States copyright law (17 U.S.C. § 101 et seq.) and international copyright treaties.

This includes — but is not limited to — all images displayed on this website, delivered to clients via galleries, shared on social media, or used in any promotional materials.

No image may be:

• Reproduced, copied, or distributed without written permission

• Edited, cropped, filtered, or altered in any way without consent

• Used for commercial purposes, advertising, or resale by any party other than Lasting Memories Fine Art Photography

• Published on stock photo websites or submitted to third-party competitions without prior written agreement

Unauthorized use of any image may result in legal action and financial penalties as permitted by law.

3. Client Image Usage Rights

Upon full payment of services, clients receive a personal, non-commercial license to use their delivered images for the following purposes:

• Personal printing (for home display, albums, gifts)

• Personal social media sharing, with photographer credit where possible

• Sharing with family and friends

This license does not transfer copyright ownership. The photographer retains full copyright at all times.

If a client wishes to use images for commercial purposes — including but not limited to advertising, business promotion, editorial publication, or product placement — a separate commercial licensing agreement is required. Please contact us to discuss terms.

4. Photographer's Right to Use Client Images

By booking our services, clients grant Lasting Memories Fine Art Photography a non-exclusive, royalty-free license to use images from their session or event for the following purposes:

• Portfolio display (website, print, in-person)

• Social media (Instagram, Facebook, TikTok, Pinterest, etc.)

• Paid advertising and marketing campaigns

• Editorial submissions, awards, and photography publications

• Educational and promotional materials

Client names and identifying personal details will not be shared publicly without explicit consent. Images will be used respectfully and in a manner consistent with the professional nature of this business.

Privacy requests: If a client prefers their images not be used in any public or promotional context, they must notify the photographer in writing prior to the event or session date. We will honor all reasonable privacy requests.

5. Website Content

All content on this website — including photographs, text, design elements, guides, and downloadable resources — is the property of Lasting Memories Fine Art Photography and may not be copied, reproduced, or republished without written permission.

The free SF City Hall Wedding Guide and any other downloadable resources are provided for personal use only. They may not be redistributed, resold, or republished in any format.

6. Booking & Service Terms

Detailed booking terms — including retainer amounts, cancellation policies, rescheduling, delivery timelines, and force majeure provisions — are outlined in the client contract provided at the time of booking. In the event of any conflict between these Terms & Conditions and a signed client contract, the client contract shall prevail.

7. Limitation of Liability

Lasting Memories Fine Art Photography's liability in any circumstance is limited to the total amount paid by the client for services rendered. We are not liable for indirect, incidental, or consequential damages arising from the use of our services or this website.

While every care is taken to deliver exceptional results, photography is subject to environmental, technical, and human factors beyond our control. We do not guarantee specific results but commit to our full professional effort on every assignment.

8. Governing Law

These Terms & Conditions are governed by the laws of the State of California. Any disputes arising from the use of this website or our services shall be resolved in the courts of Santa Clara County or San Francisco County, California.
